KidzAssist Platform Terms and Conditions of Use

Dear parents and future KidzHelpers,
Before using this website or creating your profile, please take the time to review these Terms of Use of the KidzAssist platform. Access to the website and use of the services provided through it constitute your acceptance of these Terms and your agreement to comply with them.
These Terms of Use govern the rules and legal relationship between KidzAssist, hereinafter referred to as the “Platform”, and all persons who visit or use the webpages and services accessible through this website/platform (hereinafter referred to as “Users”).
1. Definitions
For the purposes of these Terms of Use, the following terms shall have the meanings set out below:
1.1. “Platform” / “KidzAssist” – the online system accessible through the website, through which intermediary services between Users are provided.
1.2. “User” – any person using the Platform, whether as a Client or as a Service Provider (KidzHelper).
1.3. “Client” (parent/legal guardian) – a natural person using the Platform for the purpose of finding a Service Provider (KidzHelper) for childcare, educational support, or other child-related services.
1.4. “Service Provider” – a natural person offering services through the Platform, including but not limited to babysitters, educators, caregivers, early childhood development specialists, and others, hereinafter referred to as KidzHelpers.
1.5. “Profile” – an individual registration within the Platform containing information voluntarily provided by the User, including contact details, qualifications, and other necessary information.
1.6. “Subscription” – a paid service providing KidzHelpers with access to extended Platform features.
1.7. “Service” – any activity or assistance provided by KidzHelpers to a Client, including childcare, tutoring, learning support, accompaniment, and other child-related services.
1.8. “Review” / “Rating” – a comment or rating posted by a User after providing or receiving a service.
2. General Provisions
2.1. These Terms govern the relationship between KidzAssist (the “Platform”, “KidzAssist”, “we”) and all persons using the services provided through it (“Users”, “you”), including parents/legal guardians (Clients) and persons providing childcare or educational services (KidzHelpers).
2.2. By accessing and using the Platform, the User confirms that they have read, understood, accepted, and agreed to comply with these Terms.
3. Purpose and Functionality of the Platform
3.1. KidzAssist provides an online service connecting Clients with KidzHelpers — babysitters, educators, early childhood development specialists, and other persons offering child-related care services.
3.2. KidzAssist acts solely as an intermediary. The Platform is not a party to the relationship between the Client and the KidzHelper and is not the employer of either party.
3.3. All agreements, commitments, payments, and legal consequences between the Client and the KidzHelper are entirely their own responsibility.
4. Types of Users
4.1. Clients (Parents / Legal Guardians)
Clients have the right to:
- Search for and browse KidzHelper profiles
- Contact KidzHelpers directly through the Platform
- Register and search without paying any registration or search fee
4.2. KidzHelpers (Service Providers)
KidzHelpers may:
- Create a professional profile including qualifications, experience, and availability
- Receive full access to profile functionality with an active subscription plan (Section 7)
5. Registration and Profile
5.1. Registration is voluntary but required to use the core services of the Platform.
5.2. Users are required to provide accurate, current, and complete information during registration.
5.3. KidzAssist reserves the right to verify submitted information and to deactivate or restrict a profile in case of suspected false information, violation of these Terms, or reports from other Users.
6. Rights and Obligations of Users
6.1. Clients
Clients agree to:
- Use the Platform in good faith and according to its intended purpose
- Refrain from offering payments outside agreed terms with the KidzHelper
- Treat KidzHelpers with respect and fairness
6.2. KidzHelpers
KidzHelpers agree to:
- Provide truthful information regarding experience, qualifications, and services
- Offer services only within the scope of their competence and in compliance with applicable law
- Fulfill commitments to Clients in good faith
7. Subscriptions and Payments
7.1. In order to maintain an active, visible, and fully functional profile, a KidzHelper must have an active subscription.
7.2. Information regarding subscription plans and pricing is available in the Pricing section and in the user dashboard.
7.3. Payments are processed through a secure online payment system. An electronic invoice is issued after each payment.
7.4. Failure to use a subscription does not entitle the User to a refund, except where required by applicable consumer protection laws.
8. Privacy and Personal Data Protection
8.1. KidzAssist processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable personal data protection laws.
8.2. Detailed information regarding data processing is available in the Privacy Policy.
8.3. Users have the right to access, rectify, delete, object to processing of personal data, and submit complaints to the competent supervisory authority.
9. Ratings and Reviews
9.1. Clients and KidzHelpers may leave ratings and comments after a service has been provided or received.
9.2. Offensive, defamatory, false, or misleading reviews are prohibited.
9.3. KidzAssist reserves the right to moderate, edit, or remove reviews that violate the law or these Terms.
10. Prohibited Activities
The following are strictly prohibited:
- Creating fake profiles or impersonating another person
- Violating intellectual property rights
- Using the Platform for illegal activities, fraud, or abuse
- Circumventing subscription mechanisms to avoid fees or establishing contact outside the Platform in violation of its rules
11. Termination of Access
11.1. KidzAssist may temporarily or permanently block or delete a profile in cases of:
- Violation of these Terms
- Repeated justified complaints from other Users
- Violation of applicable law
12. Liability
12.1. KidzAssist shall not be liable for the actions, omissions, conduct, or service quality of Users.
12.2. All agreements, services, payments, and legal relations between Clients and KidzHelpers remain entirely their own responsibility.
13. Amendments to the Terms
13.1. KidzAssist reserves the right to amend or supplement these Terms at any time.
13.2. In case of significant changes, Users will be notified via email or through a message in their profile.
